Description
Two-page last will and testament detailing the estate of James Stewart of Pendelton County, Kentucky, dated 1849. Stewart stipulates that his "negro girl" Harriet and her three children are to be emancipated upon his death and that they should "enjoy all the rights and privileges of persons born free." Further, Stewart leaves Harriet a cow and instructs a friend to look after her to ensure she does not become a charge of the county.
Other slaves named in the document are not so fortunate. Stewart writes that his "negro man Anthony and negro boy Henry" are to be sold upon his death with his other property.
The relationship between Stewart and Harriet deserves more research.
The document is signed by Stewart with an X, "his mark," indicating he was either illiterate or too weak to hold a pen.
