Description

Manuscript legal document. Adams County, Pennsylvania, 18 November 1862.

2 pages, folio, 7 ½ x 12 ¼ in. Signed by the prosecutor Robert McGaughey and District Attorney W. I. Duncan and further undersigned by two more. Docketed to verso.

Jacob Corwell enlisted and mustered in as a private on 12 September 1861 into Company C of the 4th Pennsylvania Cavalry. Corwell, of Adams County, Pennsylvania, presumably saw action with his regiment in the Peninsula Campaign, Antietam, and the Battle of Gettysburg before his run-in with the law. The indictment here details the accusations that Corwell feloniously assaulted Robert McGaughey and stole his horse with the "value of forty dollars". It is detailed that Corwell "did beat, strike, and ill-use the said Robert McGaughey with a sword" on 17 October 1862. The military records are scant with Corwell's muster out date unrecorded and only an undated reference that he was discharged due to wounds. One record lists Corwell as deceased as of 15 March 1862, however, this is contradicted by 1890 Veterans Schedules of the Federal Census which lists Corwell still a resident of Adams County. It is possible that his legal troubles contributed his incomplete military record.
