TUPAC SHAKUR'S DEPOSITION AFFIDAVIT FOR 1993 SHOOTING CASE
An excellent, original signed and notarized document, 1p. 8 1/2" x 11", [Los Angeles], May 19, 1996 in which Tupac attests that a deposition he gave in a serious case in which he was accused of shooting two police officers was true. In a civil suit brought against him by Scott Whitwell, Tupac swears his statements are true. In full: "VERIFICATION: Personally before the undersigned notary public of said state and county, duly authorized by law to administer oaths therein, appeared TUPAC AMARU SHAKUR, who being duly sworn deposes and says that the facts set forth in the foregoing Defendant's Answers to Plaintiff's Second Interrogatories [not present] are true and correct to the best of his knowledge and belief." The affidavit is signed at the bottom in blue ink by Shakur and is counter-signed d stamped by the notary. Overall very good condition. In Atlanta in October, 1993 two off-duty police officers, brothers Scott and Mark Whitwell, claimed that a car in which Shakur was a passenger nearly struck them as they were crossing the street. An argument between the brothers and the occupants of the car resulted in the brothers being shot in the buttocks and legs. Mark Whitwell would be charged with shooting at the car and lying to police about the incident, while Shakur was charged with shooting the officers. Prosecutors dropped all charges against both parties; however, the brothers' filed a civil suit against Shakur, while Shakur countersued for $2 million, alleging that Scott Whitwell had made false accusations, and that the shooting was justified. Mark Whitwell's suit was settled out of court, but Scott Whitwell's was still open at the time of Shakur's death in September of 1996. In 1998, a default judgment was issued against Shakur's estate in favor of Scott Whitwell after the estate failed to make certain court-ordered disclosures.
