1767 LAW Heineccius & Estor Elementa Juris Civilis Holy Roman Empire German
Johann Gottlieb Heineccius was an early 18th-century German jurist and philosopher. Heineccius viewed law as a rational science recognizing that law was developed as a philosophy. He rationalized his legal doctrines with that in mind, that law and philosophy were not two separate fields.
One of his most important works was his ‘Elementa Juris Civilis.’ In it, Heineccius deals with law of the Holy Roman Empire and how it compares to that of a more ‘German’ law that was emerging. This list of hundreds of laws covers marriage, divorce, adoption, owning property, ecclesiastical law, financial donations, executions, scripture reading, and more.
This 1767 edition was edited by Johann Georg Estor, a colleague and fellow German jurist to Heineccius. Estor also recognized the changing of the German law, and his theories of public law helped influence his original 1729 edition of Heineccius’ works.
