"Our Constitution makers of 1866, though almost exclusively concerned with the restoration of state government in Texas, took time out to relinquish all minerals to landowners. This was an epochal decision - a choice between two ancient and rival theories of law and government. As a result the American common law conception of ownership of land as including all minerals therin took the place of the superceded Spanish or Mexican mining system, which treated minerals as divorced from land and as propety of the king, incapable of private ownership. ... My effort here is focused not only on this [the role of the salt lake El Sal del Rey] but other experiences, events, and controversies of a political, legislative and judicial nature during some forty years or more which induced Texas people to make such a decisive and radical change in their mineral jurisprudence." - Preface.
