We photograph in high resolution and try to accurately describe the items being sold, however, all property offered for sale is strictly "As is, Where is" and with all faults. It is the bidder's responsibility to determine the exact condition and authenticity of each item. However, having said this, no statement, whether written or oral, made in the catalog, advertisement, invoice, gallery posting, announcement or comment by the auctioneer, or otherwise, shall be deemed to create any warranty or assumption of liability. Condition reports are supplied as a courtesy to our auction participants and while we make every effort to record any flaws or other defects, there is no guarantee that every defect will be noted. Unless noted otherwise, as the items sold are antique or vintage and used, all items will have some amount and degree of wear, scratches, nicks, etc. Estimates given are an estimate of general market value and are designed to help buyers gauge what sort of sum might be involved for the purchase of any particular lot. Estimates do not include the Buyer's Premium, which is currently set at 25% of the Hammer Price. 20% goes to Home and Garden Auctions and 5% is paid by us to our hosts at LiveAuctioneers. By bidding, you are entering into a binding and legal contract with Home and Garden Auctions LLC. You are agreeing that you have either closely examined the item(s) or have chosen not to examine the item(s) or have hired an independent agent to examine the item(s) for you. No warranty is made regarding the condition of artwork frames. Absence of a Guarantee of Authenticity for Chinese Paintings The artists names recorded in this catalogue are not to be taken as unqualified attributions to the artist named. No unqualified attributions to any artist or date are made or intended. As with the major auction houses, such as Christies and Sothebys, who concur that the current scholarship in the field of Chinese paintings does not permit unqualified statements as to authorship or date of execution. Therefore, none of the Chinese paintings in this catalogue are subject to any guarantee of authenticity and all the property is sold -AS IS-. Any reference to any Terms of Guarantee does not apply to Chinese paintings. Any assistance given by the Home and Garden Auctions staff to a buyer in selecting a purchase is given without prejudice to the above. Buyers are recommended to take independent professional advice on selection of purchases. No warranty is made regarding the working condition of watches, clocks, electronic or mechanical devices of any sort or that any such item is in working condition or without defects, restorations, or working parts. All measurements are approximate. Home and Garden Auctions makes no warranty that a buyer acquires any copyright, trademark or reproduction rights for any lot purchased. Home and Garden Auctions, reserves the rights to reproduce any image of any lot sold at auction. Except as may be stated herein regarding written authenticity, Home and Garden Auctions does not accept the return of items purchased at our auctions. ALL SALES ARE FINAL. - DURING THE AUCTION - BIDDING AS PRINCIPAL: Any bidder making a bid accepts personal liability to pay the purchase price including the Buyers Premium and any applicable taxes that might be due within three (3) business days except as otherwise agreed in writing by the parties prior to the auction. ONLINE BIDS: Home and Garden Auctions makes all reasonable efforts to execute online bids. Home and Garden Auctions accepts no liability for any equipment failure, the inability to access the internet or software malfunctions related to the execution of online bids. RESERVE PRICE: Lots in the auction may be subject to a reserve or a confidential minimum sale price requested by the seller. This reserve price is confidential and will not be divulged to bidders. The reserve price will never exceed the low estimate. The auctioneer in his sole discretion may open the bidding on any lot below the reserve and bid up to the reserve. AUCTIONEERS DISCRETION: The auctioneer may, in their sole discretion, refuse any bid, advance the bidding or withdraw any lot. In the case of an error or dispute during or after the auction the auctioneer may, in their sole discretion, determine the successful bidder, continue the bidding, cancel the sale or re-offer the item in dispute. In the event of a dispute after the sale, Home and Garden Auctions record is conclusive and binding on all parties. WINNING BID: The winning bid is the highest bid acknowledged by the auctioneer. In the event of a tie bid, the winning bid will be determined by the auctioneer in their sole discretion. A dispute between bidders will be determined by the auctioneer, in their sole discretion, to determine the successful bidder or to re-offer the item. In the event of a dispute after the sale, the Home and Garden Auctions record is conclusive. Title passes to the winning bidder upon the auctioneers acknowledgment of the winning bidder subject to the Terms and Conditions as set forth herein and the winning bidder assumes full risk and responsibility thereafter. OWNERSHIP: Item ownership is conveyed immediately following the fall of the auctioneers hammer. While we always try to store all items with great care, Akiba Antiques will not assume liability for any loss or damage to an item after the hammer has fallen. - AFTER AUCTION - BUYERS PREMIUM: In addition to the hammer price, the buyer agrees to pay Home and Garden Auctions LLC a Buyer's Premium of 25%. 20% goes to Home and Garden Auctions and 5% is paid by us to our hosts at LiveAuctioneers. ADDITIONAL TAX: Sales tax will be assessed according to your State of Residence and may be included on your Invoice. If you are Tax Exempt, please see information below under the title SALES TAX. INVOICE: An Invoice from Home and Garden Auctions and LiveAuctioneers will be sent to the Buyer through the LiveAuctioneers Invoicing system. The invoice will reflect the hammer price and the Buyers Premium and will include your state sales tax, if applicable. COST OF SHIPPING: PLEASE NOTE: The costs for shipping and shipping insurance are separate from the sales invoice you will receive from Home and Garden Auctions. Shipping and shipping insurance are the sole responsibility of the Buyer and will be paid directly and separately to the shipper. PAYMENT: BUYER IS TO MAKE PAYMENT IN FULL WITHIN THREE (3) BUSINESS DAYS POST AUCTION DATE. WE DO NOT TAKE PAYPAL OR CREDIT CARDS AT THIS TIME. Home and Garden Auctions reserves the right to hold the item until the digital check has cleared. Buyer agrees to pay Home and Garden Auctions a handling fee of $50.00 for any check is dishonored or returned by buyers bank. ZELLE We offer the convenience of mobile e-payments by Zelle to our customers with USA Bank accounts. There are no additional fees attached to transactions made through your banks Zelle system. XM AND WISE Our international buyers can make payment through XM or WISE. You may also be able to pay directly through the company websites online at XE.com and WISE.com. These two companies take credit cards. WIRE TRANSFER For payments of $1,000 USD and above, please contact Home and Garden Auctions directly at info@homeandgardenauctions.com for bank-to-bank wire transfer instructions. Our Business account is held by Wells Fargo Bank. NON-PAYMENT In the event payment in full is not received from the successful bidder in good and clear funds within three (3) business days following the auction sale, Home and Garden Auctions may, in its sole discretion, exercise one or more of the following remedies, in addition to any action available by law: 1) Impose a late fee of one and one half percent (1.5%) per ten (10) days of the total invoice amount; 2) Cancel the sale; 3) Resell the item at such terms Home and Garden Auctions finds appropriate, holding the purchaser liable for any deficiency; 4) Bar the bidder from bidding in any future auctions at Home and Garden Auctions; 5) Undertake any and all other actions as might be deemed necessary or appropriate. LIMITATIONS ON LIABILITY Home and Garden Auctions acts only as Agent for the Consignor and in no event shall be liable for any breach or default by the Consignor or any representation made by the Consignor to Home and Garden Auctions. SHIPPING Lots will be released for shipping within 10 business days or earlier after your payment has fully cleared. OUR PREFERRED SHIPPER Home and Garden Auctions preferred shipping partner is the UPS Packaging and Shipping Store. We have made special arrangements with the UPS Store to have your item(s) delivered to them for FREE. You will need to contact them directly in order to obtain their packing and shipping quotes. We have also made cordial arrangements for UPS to give our Buyers a 5% discount toward shipping and a 15% discount for packaging. For large items, such as furniture, The UPS Store will pack and ship your item via UPS Freight. Please contact The UPS Store directly for quotes on items from our auctions. FREE DELIVERY TO OUR UPS STORE PARTNER After your item has been paid for and cleared, your item(s) will be delivered for FREE to the UPS Packaging and Shipping Store. STORAGE FEES If you have not made arrangements with our UPS Store partner to ship your item within 10 calendar days post auction, your item(s) will be placed in storage and may accumulate a storage fee of $10.00 per item per day. OTHER SHIPPING CARRIERS If you prefer another shipping carrier, we can supply you with names of other third party packers and shippers to whom we can have your item(s) delivered. THIRD PARTY DAMAGES Home and Garden Auctions will not be responsible for the acts or omissions of any third party packers or shippers, including any UPS Store, whether or not they were referred by Home and Garden Auctions. SHIPPING INSURANCE No matter which shipper you choose, we strongly recommend obtaining shipping insurance to cover your item in transit. SIGNATURE UPON DELIVERY We also highly recommend that a Signature upon delivery be purchased for your item so to safeguard against Porch Pirates. PRE-DELIVERY TO SHIPPER In the event a purchased item cannot be delivered to UPS or other shipping carrier due to theft or other loss, Home and Garden Auctions shall not be liable for any amount in excess of the actual amount paid for the item at the time of the sale by the buyer. CUSTOMS AND TARIFFS All international customs, duties, and other tariffs are the responsibility of the buyer. Home and Garden Auctions and all third party shippers will declare the actual selling price as the value of the item in all cases.
