Buyer's Premium 25.0% for bids up to $1000 20% for bids over $1000 This is a Timed Auction conducted by West End Art and Antiques. 1. The placing of a bid shall constitute the bidder's acceptance of these terms of sale. 2. BUYER'S PREMIUM: There will be a 25% Buyer's Premium added to the sale price (hammer) of each lot up to $1000, and 20% on lots over $1000. We accept credit cards and PayPaL 4. SALES TAX: Sales tax will apply, according to the destination State law, unless a current, valid resale certificate is provided before bids are placed. 5. INTERNET BIDDING: If you wish to bid LIVE via the Internet, you MUST pre-register. Online bidding remains open throughout the preview, and ends at the designated time listed. Please note that there may be delays or interruptions in Internet connectivity that are beyond our control. Last minute bids that do not arrive before the deadline will not be considered. 6. NEW BIDDERS: Bidders unknown to us, who anticipate an expenditure in excess of $5,000 must provide commercial references or a deposit of 25% of the amount to be bid in order to bid online. Deposits will be credited towards lots won and any balance will be refunded within 10 business days after the auction has concluded. New bidders will be given a spending limit at their initial request to participate. In order to increase this limit, you may be required to provide a letter of authorization from your bank in addition to providing references. Please contact our office at any time if you have questions regarding spending limits or references required to bid. 7. BE ADVISED: Auction participation through the live Internet bidding site is not 100% foolproof. The technology for this process is always changing, and the operation of it and the corresponding Internet connectivity issues are far beyond our control. Some folks have attempted to use the live Internet bidding process as their primary method of bidding, and have been quite successful. Others have failed completely. Depending upon your computer, server, host, and other factors, Internet signals may be delayed, such that bids may not be received in time. We cannot be held responsible for these delays, or for the lack of placed bids in a timely manner, or any other factors leading to unaccepted bids that are far beyond our control. Waiting to bid at the last minute could result in your bid not arriving in a timely manner. 9. RESERVES: This auction is without reserve. If a bid is received before the end of the auction, the item will be sold to the highest bidder. 10. BIDDING INCREMENTS: All bids must be submitted in U.S. dollars and in whole dollar amounts only in the appropriate increments as outlined in the chart above. If you choose to submit bids in an increment not listed below, your bid will be rounded to the nearest increment and you will be expected to pay the amount to which the bid was rounded should your bid be the winning bid. If you have any questions about an appropriate bid amount, please call us. 11. BID REDUCTION: All winning bids will be reduced, if necessary, to the next bidding increment up from the last competing bid, as long as the minimum bid requirement has been met. For example, if you submit a bid of $1000 and the next highest competing bid is $250, then you will win the lot for $275. 12. BID INFORMATION: The minimum starting bid and estimated values are displayed on the bid page. The highest current bid is displayed as well. 13. BID CANCELLATION: For Timed Auctions: You can cancel an absentee bid placed in a Timed sale up until two hours prior to the auction?s first lot end time, and a maximum of three bids may be cancelled per session. Absentee bids left before the auction can be retracted up to 2 hours prior to the auction. No other bids can be retracted. To retract an absentee bid, visit the My Bids page at liveauctioneers.com, locate your bid, and click "Retract". 14. INVOICING: Shipping charges will be added to all invoices. Invoices are mailed or emailed within two business days after the close of all portions of the sale. Within 7 calendar days of receipt of invoice, payment is due in full to West End Art and Antiques, 154 West End Ave., Knoxville, TN 37934. LATE FEES and LEGAL ACTION MAY BE ADDED IF PAYMENT IS NOT RECEIVED WITHIN 15 DAYS of the end of the Auction. Any waiver of late fees must be obtained in writing from West End Art and Antiques. After 15 days, a late fee of 10% will be added to the invoice for each 30 day period the bill remains unpaid. Sales tax will be added to the invoice iif required by the purchasers state,unless a resale certificate is provided. 15. PAYMENT: We accept LiveAuctioneers Payments, Visa, Master Card, American Express, Discover, Money Order/Cashier's Check. Customers wishing to pay by check or money order MUST contact our office for an invoice total before sending payment All returned checks are subject to a $25 fee. Cash received in amounts greater than $10,000 is subject to the filing of IRS form 8300, as required by law. 16. SHIPPING & HANDLING: Shipping and Handling costs are listed in the description, when possible, and based on the size and weight of your purchase. If a shipping cost is not listed in the description, it will be determined after the sale, If additional shipping and handling costs are required, the buyer will be re-invoiced for the balance due. Items are not shipped until the invoice is completely paid. Insurance is included in all shipping quotes. Shipping to areas other than the 48 states are subject to additional charges and possible tariffs or taxes in the case of international customers. Many buyers purchase a number of lots. Every effort will be made to include all lots in a single shipping charge calculated to cover the weight and size of the package(s). NOTE: Some shipments (of unusual size, dimension, or weight) may require special handling for which individual costs will be calculated and applied to the shipping charge on the invoice. The customer is responsible for all shipping charges. Purchases will be shipped via our approved, insured carriers: Federal Express, UPS or the US Postal Service. All items shipped by Federal Express, UPS or USPS will be insured for the amount of the highest bid plus buyers premium. Pick up is available from our Knoxville, Tn office the next business day after the auction. 17. NON-PAYMENT: West End Art and Antiques reserves the right to cancel any invoice not paid in full within 15 days. A cancelled invoice does not relieve the bidder from their obligation to pay seller fees and buyer's premiums compensating West End Art and Antiques for its services in conducting the auction. Interest shall run on all outstanding balances at the highest rate permitted by law. West End Art and Antiques shall have a lien against the merchandise purchased by the bidder, and any other of bidder's property then held by West End Art and Antiques, to secure payment of the invoice. West End Art and Antiques shall have all the rights of a secured creditor under the Tennessee Commercial Code, including but not limited to the right of sale. West End Art and Antiques may sell the lot(s) securing the invoice to any under bidders in the auction that the lot(s) appeared, or at subsequent private or public sale, or relist the lot(s) in a future auction conducted by West End Art and Antiques. A defaulting bidder agrees to pay for the reasonable costs of resale (including a 20% seller's commission, if the defaulted lot(s) are consigned to an auction conducted by West End Art and Antiques), the defaulting bidder is liable to pay any difference between his or her total original invoice for the lot(s), plus any applicable interest and selling fees, and the net proceeds for the lot(s). If West End Art and Antiques refers any invoice to an attorney for collection, the defaulting bidder agrees to pay attorney's fees, court costs, and other collection costs incurred byWest End Art and Antiques. Any bidder who fails to follow the terms of payment will be reported to Live Auctioneers, and may be barred from participating in future West End Art and Antiques auctions. Any and all legal disputes arising from the auction will will be governed by the the laws of the state of Tennessee, If a private solution to a dispute cannot be reached, signing up and bidding on an item in this auction, has obligated you to the terms and conditions listed in the Terms and Conditions section, and as noted in paragraph 1. Your recourse is limited to binding arbitration in Knox County, Tennessee and limited to the actual invoice amount for the goods that you bid on. West End Art and Antiques shall not be responsible for consequential damages, incidental damages, compensatory damages, or any other damages arising or claimed to be arising from the auction on any lot. Bidder's sole remedy for any proven act or omission shall be rescission of sale and refund of the amount paid by Bidder. 18. CONDITION: We strongly recommend that you study the photographs carefully to see lots in their entirety. We do our best to convey the condition of an item as clearly as possible, however the condition of an item can be subjective, and large lots may not be itemized due to catalog restraints. Our photographs have not been enhanced in any way, and have been taken at high resolution which allows you to zoom in and see any defects or flaws. Bidders are responsible for understanding the condition of items. Conditions noted are subjective, and may differ in the opinion of different people or collectors. Requests for additional information must be submitted 3 business days prior to the end of the auction. 18a. ALL ITEMS ARE SOLD ?AS IS?, RETURNS ARE ONLY ACCEPTED IF THE DESCRIPTION OF THE ITEM IS INCORRECT. 19. RETURN POLICY: All items are guaranteed to be as described in our catalog. If your item is not as described, please call our office for assistance. ALL SALES ARE FINAL. You may only return any piece that was significantly inaccurately described by calling our office within 10 days of receipt of item(s) and notifying us of the error and reason for return. We do not refund postage or insurance. Please call us if you require a more specific condition report. Any items that are returned must be returned in the exact, unaltered condition. When we receive your bids we will assume you have read the description in the catalog, viewed the image of the item, have contacted us regarding any questions you may have on any lot and/or have previewed the lot in person. 21. Any claim, dispute, or controversy in connection with, relating to and/or arising out of the Auction, participation in the Auction, award of lots, damages of claims to lots, descriptions, condition reports, provenance, estimates, return and warranty rights, will be determined by the prevailing laws and Binding Arbitration in Knox County, Tennessee. These Terms and Conditions cannot be verbally modified by any agent of West End Art and Antiques. Any changes to these Terms and Conditions can only occur with the written consent of West End Art and Antiques. THE PARTIES EXPRESSLY WAIVE ANY RIGHT TO TRIAL BY JURY. Any claim must be brought within one (1) year of the auction from which the claim arose or the claim is waived. 22. Copyright and Trademarks: Items in this auction may have copyright and or trademark protection, which could prevent a buyer from duplicating or publishing that item. There may be other copyright and trademark limitations as well, as provided by law. West End Art and Antiques makes no warranties as to the copyright or trademark status of any item appearing in this auction. Obtaining reproduction rights to any item is the sole responsibility of the buyer, and West End Art and Antiques has no information or advice as to how to accomplish this. 23. West End Art and Antiques shall not be held responsible for any problem due to the bidder's failure to follow the rules, terms and conditions of this sale, or any failure to bid due to the loss of the online auction process provided by any of the online auction networks; or missed bids, changed bids or cancelled due the bidder's failure to follow the proper bidding procedure outlined herein. 24. Buyers Premium 25% for bids up to $1000, and 20% for bids over $1000 25. Placing a bid on an item in this auction indicates that the Bidder accepts these Terms and Conditions, and specifically agrees to all of the Terms herein, with the explicit understanding that damages cannot exceed the hammer price of the disputed item.
