Description
1846 Abraham Lincoln Penned and Twice Signed Pleading, dated September 11, 1846. This Fresh to the Market document is Lincoln's answer in the Clark vs. Wells debtor/creditor case in Tazwell County, part of Lincoln's 8th Judicial Circuit, in which the presiding judge was the legendary Samuel H. Treat, the Illinois Supreme Court Justice. This document is also twice signed by Benjamin James, a Tremont, Illinois attorney who was very active politically and professionally in Tazwell County. This document is FRESH TO THE MARKET, not known or recorded in "The Law Practice of Abraham Lincoln Complete Documentary Edition" published by the University of Illinois Press. CASE SUMMARY: Shurtleff owed Allen $3,000 for goods, merchandise, and labor. Both Shurtleff and Allen died before the commencement of a suit. Wells, administrator of Allen's estate, sued Clark, administrator of Shurtleff's estate, for the $3,000 debt and an additional $3,000 in damages. Clark retained Lincoln. Apparently, the parties reached an agreement, and Wells dismissed the case. Lincoln received $5 for his legal services.
