Auction Overview Oil Painters of America's live auction will be conducted on-line only on Thursday, December 4th at 10:00am CST. All paintings are available for on-line bidding through LiveAuctioneers.com. PAYPAL is the ONLY accepted form of payment. Payment for won items is expected following completion of the auction and after an invoice is issued and sent by a representative of Oil Painters of America. TERMS and Conditions of SALE Please read all terms and conditions in full. By registering to bid, you accept and agree to these terms and conditions with no exceptions and understand that you are entering in to a contract to abide and accept these terms. All paintings are sold UNFRAMED. Descriptions are given to the best of our ability and knowledge. No statement in these terms shall be deemed a warranty, representation, or assumption of liability on the part of Oil Painters of America. All photographic representations are solely for guidance and are not to be relied upon in terms of tone or color or necessarily to reveal any imperfections. The auctioneer reserves the right to refuse admission to the sale or to refuse to recognize any or all bids from any particular person or personas at any auction. The highest bidder acknowledged by the auctioneer will be the purchaser. In the event of a dispute between bidders, or in the event of doubt on our part as to the validity of any bid, the auctioneer will have the final discretion either to determine the successful bidder or to reoffer and resell the article in dispute. If any dispute arises after the sale, our sale record is conclusive. On the fall of the auctioneer's hammer, title will pass to the highest bidder acknowledged by the auctioneer, subject to the conditions set forth herein, and such bidder thereupon (a) assumes full risk and responsibility therefore, (b) will thereupon pay the full purchase price therefore or such part as we may require. Please contact us to resolve any questions before bidding. All paintings are sold to the highest bidder AS IS, excluding shipping charges and sales tax, if applicable. All sales are final. There are no returns or refunds. If Buyer defaults in its dealings with Oil Painters of America and/or LiveAuctioneers.com or breaches Buyer's obligations, Buyer agrees to pay to Oil Painters of America all damages and attorney's fees and expenses, together with interest at the highest rate allowed by law or 21 percent per annum. Contract The bid is a contract. Bidders should place a bid only if he/she is serious about buying the item. If you are the successful and winning bidder, you have entered into a legally binding contract to purchase the property bid on from the seller. You should contact the auctioneer to resolve any questions before bidding. Shipping Buyer will be charged a flat shipping rate of $100 US for shipment to Canada, Mexico or The United States. A $200 US flat rate will be charged for items shipped internationally. This will include any packaging materials used. Once actual shipping and packaging material charges have been determined, if due, buyer will receive another invoice for additional shipping charges OR refund for overpayment. All items are shipped INSURED and TRACKED at the buyer's cost. WE DO NOT ADD ANY FEES TO SHIPPING. Oil Painters of America is not responsible for items that are damaged in any way by shippers. If a problem arises, all claims must be settled between the buyer and shipping company. Upon confirmation of payment for the auction item purchased, and receiving the buyer's shipping arrangement requirements, the purchased item will be shipped within ten business days. Payment PAYPAL is the only method of payment accepted, no exceptions. Oil Painters of America expects payments within 72 hours of auctions end. All Payment is in US Dollars. You will receive an invoice from liveauctioneers within 12 hours of auctions end. This will include final hammer price, taxes if applicable, and flat shipping rate. Taxes Goods and Services Tax of 7.75% will be charged on the hammer price on all paintings delivered within Illinois.
