DeFina Auctions Terms and Conditions Online bidders - If your bidding on line, you must adhere to online bidding terms and conditions. A buyer's premium of 18%, or 21% for Internet bidding, will be applied to all property sold, to be paid by the purchaser as part of the sale price. ESTIMATES Price ranges listed below with the lot description are estimates and nothing more. We base the estimates on our experts? opinions and past auction results, taking into account rarity, condition and other subjective criteria. Use the estimates only as approximations, since they may not reflect the actual selling price. CONDITIONS OF SALE We encourage you to call us with questions about our service or items in our auctions. Make certain that you are satisfied with our description before you bid! Your satisfaction with both our merchandise and our auction house is important to us. We try to describe all auction lots completely, fairly, and conservatively, and we make a concerted effort to include defects in descriptions. The lots listed in each auction will be offered by DeFina Auctions to the following terms and conditions: The property is sold "as is", and neither the auctioneer nor any consignor makes any warranties or representations of any kind or nature, and in no event shall be responsible for the correctness, nor deemed to have made any representation or warranty of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property, and no statement made at the sale, or in the bill or sale or invoice, or elsewhere shall be deemed such a warranty or representation of an assumption of liability. All measures and weights are approximate. Defina Auctions reserves the right to reject any bid, as well as the right to refuse to acknowledge any bidder. The highest bidder acknowledged by the auctioneer will be the purchaser. In the event of a dispute between bidders, the auctioneer has the final discretion to re-offer the lot in dispute. If any dispute arises after the sale, DeFina Auctions, sale record shall be conclusive. TERMS OF SALE Cash(In House Only) or checks are accepted with positive identification; out of state checks will need a bank letter of credit. All purchases are subject to a county 6.5% sales tax, unless the buyer has proof of exemption. Gallery bidders must pay for items at the end of each session. We must receive payment from absentee, phone, and online bidders within one week of the auction. Personal or business checks must clear before shipment is made. (This could take as long as twelve business days.)We do not accept Paypal BIDDING We will not be held responsible for failing to execute phone, Internet, or absentee bids of any kind. We extend this service as a courtesy to our customers who cannot attend the sale or who do not wish to be identified as bidders. Remember, you are bidding at a live auction. Tie bids: Placing an early internet or absentee bid prior to the auction does not give you any advantage over other bidders in the case of a tie bid. All bids will be executed in a competitive manner on auction day. The highest bidder acknowledged by the auctioneer will be the purchaser of the lot. BIDDER REGISTRATION All on line bidder registration will end st 5:00 pm the day proir to the auction. Please do not call to register beyond this point as we will not be able to help you. REMOVAL OF PROPERTY Any merchandise not paid for in full the day of the auction will be kept in storage for no more than 7 days.  After 14 days the merchandise, without reserve, will be resubmitted in the following auction, holding the purchaser liable for any deficiency plus all costs of sale.  DeFina Auctions shall not be liable for any damage to property left on the premises.  Any property that has not been removed from the gallery within 30 days from receipt of payment will incur storage fees.  Contact gallery for schedule.  No property will be released until storage fees are paid in full. Property left over 3 months will be considered abandoned and no refunds will be issued. Please note! - We do not ship! 1. Shipping with private shipping companies can be Expensive! 2. DeFina Auctions is in no way responsible for the acts or omissions of independent handlers, packers or shippers of purchased items or for any loss, damage or delay from the packing or shipping of any property. All purchased items can be picked up by appointment From 9:00 a.m. to 5:00 p.m. Monday through Friday.
