All bidders must be 18 years of age or older. All information on the registration form must be current, complete, and accurate. All items are sold as is, where is, with all faults. All bidders are encouraged to use due diligence prior to bidding. There are no warranties or representations of merchantability, fitness, nor of any other kind, express or implied. Know that your bidding will signify that you have examined the items as fully as you desire, or that you have chosen not to examine them. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to age, condition, materials or any other feature of items being sold. Our goal is to provide prospective bidders with accurate and detailed information. We do not give refunds. All sales are final. All items are listed as is and where is. No statement written or oral made by the auctioneer shall be deemed a warranty or assumption of liability by Hills Collectibles or by any seller represented by Hills Collectibles. You must reach out to us with questions prior to placing a bid. You assume full responsibility of an item once you bid on it and win it. Storage We do not offer storage services or hold items. Items that cannot be claimed or shipped within 30 days become the property of Hills Collectibles for disposal or relisting. Fees & Payment Methods: All Transactions are in Canadian Dollar (CAD) Funds. A deposit of Fifty dollars (CAD) may be put on hold as a deposit on your credit card at registration at our discretion. This is a hold and not a charge. • Winning Bidder's Premium: 20% ($0-$10,000) and 18% ($10,000+) • Processing Fee: 2.5% (we only accept credit cards, debit cards, ACH transfers, - no cash, PayPal or checks) An invoice will be sent to the winning bidder within 48-hours of the close of the sale. All payments are due immediately upon receipt of invoice. Autopay – Very Important If you have not contacted Hills Collectibles to arrange payment of your invoice within a day from the time it was sent, we will charge the credit card you used to register for the auction for the full amount of your invoice including shipping costs. Taxes: Unless you are exempted by law, the winning bidder is required to pay Harmonized Sales Tax (HST) on the total purchase price including Winning Bidder’s premium. International Winning Bidders are not taxed if the purchases are shipped out of Canada. For items shipped out of Ontario and within Canada, the winning bidder is required to pay taxes either GST or HST depending on the province. Shipping: 1. Winning Bidders pay shipping costs including packing materials, handling fees, insurance, and customs duties (if any, please check with your countries’ customs offices). We automatically calculate shipping fees for one item following an auction. You may pay for our quote and we will handle on your behalf or you may arrange your own shipping. You may have this shipping fee removed from your invoice by simply emailing us and arranging your own pickup or delivery. It can take 3-4 weeks to receive an item won at auction. Once paid, we work very hard to coordinate the logistics of getting the item into your possession. 2. Shipping fees vary due to different shipping locations. Actual shipping fees will be based on particular zip codes, the value of the items, the size, weight, and materials. Winning Bidders are encouraged to request for a quote before bidding or after winning any items. 3. Our In-house shipping staff will professionally pack your items and ship them to you via Canada Post, DHL or UPS within 14 business days after receipt of cleared invoice payment for purchases to be packed for shipping. 4. Shipments include mandatory insurance, tracking, and signature delivery confirmation. Once shipped, buyers receive their shipment tracking information by email. Returns: Under no circumstance except for fraud may an item be returned to Hills Collectibles. In the case that an item is authorized to be returned to Hills Collectibles, store credit in the amount of that item's sale shall be applied to that bidder's account until Hills Collectibles can make a final determination on the case through direct review. If Winning Bidders have questions about any items, please contact us before bidding or making offers. Winning Bidders should make their judgments of any item independently. Hills Collectibles does not accept any excuses for non-payment, no returns will be accepted, and no refunds will be made. Bidding Hills Collectibles has sole and exclusive discretion, and authority to regulate the bidding increments. You hereby expressly waive any and all claims you may have, now or in the future, arising out of or relating to the Hills Collectibles, any and all contracts you enter into with the Hills Collectibles, and any and all of the Hills Collectibles products and services. To the extent that you attempt to assert any such claim, you hereby expressly agree to present such claim only through binding arbitration to occur in or near Brampton, Ontario Canada. You further agree to and do hereby waive any right to class arbitration and agree, instead, to conduct an arbitration related solely to any individual claims you and/or any entity related to you asserts against the Hills Collectibles. To the fullest extent permissible by law, you further agree that you shall be responsible for all costs associated with initiating the arbitration and for the administration of the arbitration.
