TERMS AND CONDITIONS All merchandise is publicly displayed prior to auction. BUYER BEWARE, purchases will be at the buyer's own risk. Each item is sold AS IS, WHERE IS, and WITH ALL FAULTS. We recommend that each item be examined thoroughly. Internet purchasers are urged to have items inspected by an independent appraiser or a third party consultant during set preview times if they are unable to attend themselves. Neither Motley's nor the consignor makes any warranty or guarantees at the time of sale, either expressed or implied. Prospective bidders are urged to inspect property before bidding to determine condition and whether or not items have been repaired, restored, or damaged. Some items in this auctions have been subjected to extensive use. The catalog/internet listing is to be used as a guide of what is being sold. It is our intention to catalog each lot accurately and fairly; however, Motley's cannot guarantee accuracy or authenticity. The catalog is intended to be used as a guide for your convenience. All announcements made during the course of the auction will take precedence over any previously printed material. ALL SALES FINAL! No items may be returned for credit. Due to circumstances beyond our control it, at times, becomes necessary to pull or remove items from the auction. 1. BIDDING: All bidders must register online. Bidders are bound by Motley's Auction & Realty Group Terms & Conditions of Sale. Please bid as early as possible. In the event of duplicate bids, the earliest bid will take precedence. The auctioneer has the right to refuse any bid not commensurate with the value of the item being sold. If any dispute arises after the sale, Motley's sale records shall be conclusive in all respects. Consignors may not bid on their own property. Pooling or collusive bidding will not be tolerated. 2. BUYER'S PREMIUM: A 20% buyer's premium will be applied to the successful sale price for all online bidders. This premium will be added to each and all lots sold in the auction. Please bid accordingly. 3. PAYMENT: Payment accepted by Visa, MasterCard, personal check, company check, cash, or cashier's check. Purchases must be paid for by Friday, February 26, 2010 at 5:00pm EST. Personal or company checks for full settlement over $500.00 MUST be accompanied by a current irrevocable bank letter of guarantee or prior approval. Motley's reserves the right to hold items paid for by personal check until we receive proceeds from buyer's bank. In the event Purchaser fails to pay the full purchase price of any lot as per these terms and conditions set forth herein, Motley's shall retain a lien on all lots of Purchaser until all items are paid in full. This lien shall include funds for original purchase price, sales and use taxes, buyer's premiums, transportation and handling fees, storage charges, security and insurance. In addition, Motley's, at its sole discretion, shall have the right to sell such lots by public or private sale without notice to Purchaser at a commission rate of 35% plus any expenses outlined above. 4. REMOVAL: All items MUST be removed by March 3, 2010 at 5:00PM, (between 8:00AM and 5:00PM Friday, and between 1:00PM and 5:00PM Monday through Wednesday). We strongly recommend that you supply your own labor. Any variance from our announced removal schedule must be arranged. Purchaser takes full responsibility for the removal of lots and holds harmless the consignor and auction house for any damage or injury in the moving or dismantling process. Motley's cannot supply ropes, blankets, cardboard or any materials for packing items into or onto vehicles. 5. Lighting Terms: This auction includes a special collection of important lighting. Please be aware that only select examples of this lighting are on display as representatives of lighting that are of the same style or type for several lots. For example lot 4500 is displayed in our gallery and is representative of lots 4500 - 4507. Buyers of the lighting displayed in the gallery are responsible for its disassembly and removal and we will be glad to recommend to you professionals you may employ to do such. Many of the images of the lighting displayed in our online catalog were taken when the lighting still hung in the VA State Capitol and may have had certain elements removed for transportation or storage. Most, but not all, of the lighting includes a custom-made wooden crate for moving and/or shipment and, other than the examples hung in our gallery, the other matching lots are unassembled and stored in these crates for your convenience in moving. Those with a crate will have it listed in the item's description. For your convenience, we have a shipper who can transport and ship your purchase anywhere within the continental United States. Motley's can also provide you with contact information on local businesses that can restore, install, and provide replacement parts for all lighting. We have tried to note condition issues but, at times, this is not apparent to us and given the age and prior use of the lighting some elements may be chipped, cracked, missing, or need general restoration which the buyer will be responsible for. We strongly recommend having all wiring and elements inspected by a professional of your choice prior to your purchase. Good luck with your historic lighting purchases and please let us know if we can assist you with a referral to an individual or business that can perform any of the aforementioned services. **Items remaining after March 3, 2010 will be subject to a storage fee of $5.00 per lot/per day. Items left over 30 days will be deemed abandoned. Abandoned purchases will be sold without notification to offset storage fees and handling.
